Actor Jackie Shroff has taken a decisive step by approaching the Delhi High Court to address the unlicensed exploitation of his name and persona for commercial purposes. His counsel highlighted concerns over the misuse of Jackie Shroff’s personality attributes, including the sale of merchandise, ringtones, wallpapers, and the circulation of “insulting” memes and GIFs, as well as the use of artificial intelligence without proper authorization.
The lawsuit also emphasizes the alleged infringement of Jackie Shroff’s trademark rights on the Marathi slang term “bhidu.” His legal representative pointed out that this unauthorized usage not only violates his rights but also misleads consumers into believing that these products and content are endorsed or associated with the actor.
Justice Sanjeev Narula of the Delhi High Court has issued summons to the entities involved in the unauthorized use of Jackie Shroff’s name and image, scheduling further deliberation on the matter for Wednesday.
The counsel for Jackie Shroff argued that such activities undermine the actor’s marketability and reputation, given his extensive career spanning over 200 films. The unauthorized sale of merchandise, including items like mugs, signed posters, and bags, online without his consent, is a direct violation of his rights.
Additionally, the legal team highlighted the existence of derogatory and objectionable content, such as memes and morphed images, which further tarnish Jackie Shroff’s image and brand.
While some defendants have discontinued the unauthorized use of Jackie Shroff’s personality traits, the lawsuit remains focused on addressing past infringements and preventing future unauthorized exploitation.
